1. Your Contract with Euro Tripping
(a)Deposit European group rail tours: The greater of $100 or 15% of the total tour price. Unless at short notice in which case full payment due at time of booking. To secure a booking Euro Tripping requires a non-refundable deposit priced as above, per person, per component. Full payment is required if travel is due to commence within 30 days for European tours. This payment is deemed to be confirmation that the client has read and accepts the Euro Tripping booking conditions. Clients booking through a travel agent or by telephone, fax, email or online will be deemed to have read the booking conditions and accepted them.
(b)Offers for Short Escapes, Self Discoverers and Essentials Trips : Valid prices as stated on website or in the case of a personalised quote, for a period of 24hrs after being sent to client and must be accepted via email, phone or method stated in each quote/invoice. We reserve the right to change prices on our website as deemed necessary through cost increase or currency influctuations.
Deposit For Self Discoverers and Essentials Trips : The greater of $100 or 15% of the total trip price. Unless at short notice in which case full payment due at time of booking. To secure a booking Euro Tripping requires a non-refundable deposit priced as above, per person, per component. Full payment is required if travel is due to commence within 30 days for European tours. This payment is deemed to be confirmation that the client has read and accepts the Euro Tripping booking conditions. (c) Offers for Hotel Price Beat and Hotel Best Price Finder: Valid for a period of 24hrs after being sent to client and must be accepted via email, phone or method stated in each quote/invoice.
Deposits for Hotel Price Beat and Hotel Best Price Finder: These are subject to individual terms and conditions based on terms outlined in each individual offer. These conditions can be found in the quotes and invoices sent by Euro Tripping Travel.
(d) Offers for Flights: You will be required to pay a deposit or deposits when booking. Your consultant will advise you of how much that will be. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law). Final payment is required no later than 6 weeks prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.
A booking is accepted and becomes definite only from the date when Euro Tripping has confirmed acceptance by issuing an invoice. Errors or omissions on the invoice may be subsequently amended after advising the client in writing. It is at this point that a contract between Euro Tripping and the client comes into existence. Before your booking is confirmed and a contract comes into force, Euro Tripping reserves the right to increase or decrease prices. Euro Tripping reserves the right to decline any booking at our discretion.
The contract is between Euro Tripping and the client, being all persons named on the booking as travelling or intending to travel with Euro Tripping. The person making the booking (which is subject to these terms) warrants that he or she has full authority to do so on behalf of all persons named, and confirms that all such persons are fully aware of and accept these conditions.
The contract, including all matters arising from it, is subject to Australian law and the exclusive jurisdiction of its respective courts. No employee of Euro Tripping other than a director has the authority to vary or omit any of these terms or promise any discount, reward or refund.
2. Payment for your trips/tours/self discoverers/short escapes
(a) The balance of all monies due on Self Discoverers and Essentials Trips including any surcharges applicable at that time, must be paid not later than 30 days before departure . In the case of non-payment of the balance by the due date, Euro Tripping will treat the booking as cancelled by the client and apply the appropriate cancellation charges. Monies paid to an agent acting on behalf of Euro Tripping are held by the agent on behalf of Euro Tripping.
(b) The balance of all monies due on Hotel Price Beat and Hotel Best Price Finder including any surcharges applicable at that time, must be paid by the specific date laid out in the quote/invoice terms and conditions. In the case of non-payment of the balance by the due date, Euro Tripping will treat the booking as cancelled by the client and apply the appropriate cancellation charges. Monies paid to an agent acting on behalf of Euro Tripping are held by the agent on behalf of Euro Tripping.
(c) The balance of all monies due on European Group Rails Tours, including any surcharges applicable at that time, must be paid not later than 30 days before departure. In the case of non-payment of the balance by the due date, Euro Tripping will treat the booking as cancelled by the client and apply the appropriate cancellation charges. Monies paid to an agent acting on behalf of Euro Tripping are held by the agent on behalf of Euro Tripping.
3. Payment for your flights
(a) The balance of all monies due on flights including any surcharges applicable at that time, must be paid by the specific date laid out in the quote/invoice terms and conditions. In the case of non-payment of the balance by the due date, Euro Tripping will treat the booking as cancelled by the client and apply the appropriate cancellation charges. Monies paid to an agent acting on behalf of Euro Tripping are held by the agent on behalf of Euro Tripping.
(b) Credit card surcharges for Australian cards are 1.79% for Visa & MasterCard (inc. debit), 2.90% for American Express, and 3% for Diner’s Club and 2.9% for overseas cards. This fee will apply when paying by credit card.
You authorise us to charge all fees incurred by you in relation to the services provided to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand
4. Changes for trips/tours/self discoverers/short escapes (Without flights)
4:1. Changes by you
We will do our best to assist you in altering your arrangements after booking, but cannot guarantee that this will be possible. Any changes to the original booking must be confirmed in writing by the lead customer and must be accompanied by charges as per the below table in addition to the cost of any extra services required.
Written notification is essential even if verbal notification of an intention to change has been given. Charges will be applied as shown below, calculated from the day written notification is received by Euro Tripping.
The date used for calculating charges:
- 60 days or more before the holiday Package/Tours departure day: $50 per booking administration fee.
- 35-59 days before the tour departure day: 70% of total cost of booking
- 35 days or less before the tour departure day: 100% of total cost booking
Whilst every reasonable effort will be made to accommodate changes and additional requests their availability cannot be guaranteed.
4:2. Changes by us
While Euro Tripping will use its best endeavours to operate all tours as advertised, by entering into this contract the client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions.
Euro Tripping reserves the right at any time either before or during a tour to cancel or change any of the facilities, routes, services or prices described in the brochure (including transport, accommodation or other arrangements) and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes.
If a major change is known to us, the client will be told at the time of booking. If a major change becomes necessary, Euro Tripping will inform the client as soon as reasonably possible if there is time before departure.
The definition of a major change will depend on the individual’s tour and circumstances as is at the sole discretion of Euro Tripping. When a major change is made the client will have the choice of accepting the change of arrangement, or within 7 days notification of the change, purchasing another available tour or cancelling the tour and obtaining a full refund, provided that the major change is not because of force majeure.
Force majeure is war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with local transport or Euro Tripping vehicles, changes imposed by cancellation or rescheduling of flights by an airline or aircraft type, or other similar events beyond the control of Euro Tripping. Euro Tripping is not liable for any penalty charges associated with non-refundable airfares, in the event of a change to a tour departure time, date or airport. All costs incurred due to force majeure, such as transport, communication, accommodation, food or other similar items will be passed to the client by way of local surcharges.
5. Cancellation by you for trips/tours/self discoverers/short escapes(without flights)
The client may cancel the booking at any time provided that the cancellation is communicated to Euro Tripping in writing. Written notification is essential even if verbal notification of an intention to cancel has been given. Cancellation charges will be applied as shown below, calculated from the day written notification is received by Euro Tripping.
Your deposit is non-refundable. The date used for calculating further cancellation charges will be as follows:
- 30 days or more before the tour, trip departure day or hotel check in date: full deposit is forfeited
- 15-30 days before the tour departure day: 70% of total cost is forfeited
- 15 days or less before the tour, trip departure day or hotel check in date: 100% of total cost is forfeited
6. Changes and Cancellations for flights
Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellation fees apply to all bookings (including online bookings and bookings made with a consultant):
- Changes to Domestic/Trans-Tasman bookings will incur a fee of $50 per passenger per booking in addition to supplier fees.
- Cancellations to Domestic/Trans-Tasman bookings will incur a fee of $75 per passenger per booking in addition to supplier fees.
- Changes to International bookings (excluding Trans-Tasman bookings) will incur a fee of $100 per passenger per booking in addition to supplier fees.
- Cancellations to International bookings (excluding Trans-Tasman bookings) will incur a fee of $300 per passenger per booking in addition to supplier fees.
7. Cancellation and Changes by supplier on flights
Cancelled bookings may also incur supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee. Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.
8. Departures for Tours
Tours operated by Euro Tripping are not guaranteed departures and reserve the right to cancel a tour if it falls below minimum numbers. In this situation Euro Tripping will offer to move passengers of said cancelled tour onto a running tour. If the passengers for what ever reason cannot attend the rescheduled tour allocation, then Euro tripping will pay back any deposits and payments made in full. In the case of Nepal Trekking an alternative tour will always be offered for the same time frames as the original tour, in this case if the passenger decides to decline alternative tour the deposit amount will not be repaid to the client. Euro tripping will operate departing tours unless force majeure circumstances arise or other unforeseen circumstances. Due to the traveller numbers on a specific tour, Euro Tripping reserves the absolute right to change the type or style of transportation or other elements, to enable the tour to operate.
Force Majeure: We will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, acts of God, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport.
9. Terms for Group Rail Tours
9:1. All Group Rail Tours
On any of our Tours, accommodation is provided in twin accommodation. Singles travellers will be accommodated in same-gender twin rooms. Two travellers booking together will be accommodated in a twin room. Three travellers booking together will be accommodated in one twin room, the third person will be accommodated in a same gender twin share room. Euro Tripping will use astute discretion at allocating the third person to a room share; unless we are otherwise advised in writing as to who will be sharing with whom. Triple rooms can be requested, in writing, but cannot be guaranteed in every location in which event the above situation applies. In certain locations, particularly in Austria and Switzerland, a twin is commonly accepted as referring to two separate mattresses and duvets contained in one large frame. Most hotels have rooms that will take an extra bed if required. These extra beds may be bunk beds, fold-away beds or sofa beds. Where an extra bed is added this may limit the space available. Rooms with extra beds are still bookable for two person occupancy although, in this case, the hotelier may allocate a standard-sized twin bedded room without extra beds. Single rooms do not always match up either in size or facilities to twin bedded rooms. Please note that in some properties, lifts may not directly service all floors and access to and from these floors may be by stairway only.
9:2. Star Categories / Country Standards
We use a range of 4 & 5 star rated accommodation establishments in our set tours or a star rating as per your request if you use our travel concierge, or hotel services.Please be advised that standards differ from country to country. The star ratings are primarily intended to give a guide to the range of facilities and services available in each property. 2 and 3 star properties generally have a more limited range of facilities and services. In general the overall standard of services and facilities can sometimes vary within star categories. For example, an officially rated 3 star property may only possess 2 star standards (and vice versa) despite having an extensive range of services and facilities. This is because of the many different criteria that are used from country to country to assess star ratings.
Please note these criteria can differ significantly to those used in the UK by motoring and other organisations and UK ratings should not therefore be compared to those overseas. In certain instances, hotels and pensions in Austria do not have official star ratings, mainly due to taxation reasons, rather than levels of standard.
10. Our staff
Our staff have been carefully chosen, and undergo comprehensive training. Tour leaders and drivers are authorized to have well deserved rest during tour; these are the ‘free days’ as part of the tour itinerary. Although the staff are on a rest day, they are on call for any emergencies.
Meals are included as stipulated in the tour itinerary, check your specific tour itinerary for details of which meals are included. Vegetarians or those with special dietary needs can be catered for, so please inform us at the time of booking, as well as your tour leader at the start of the tour. Non-included meals are at your own expense. This allows you the opportunity to try the local cuisine. The food is delicious and varied with restaurants providing an important insight into local ways of life.
There is always an excellent range of restaurants to choose from. You may also need to purchase drinks and snacks for long bus or rail journeys as there may not be the opportunity once on board. Please be aware that in many parts of the world vegetarian meals are classified as meals without meat or fish, and may not be what you are used to.
12. Surcharges & Tour prices
All prices published in printed brochures and other printed media prices may vary from time to time due to exchange rates, operational costs or travel seasons or years. Correct prices are published on the Euro Tripping website and are valid at the time of booking.
No refunds or discounts are due if the price is subsequently reduced, and all prices may be subject to surcharges as set out below. Euro Tripping reserves the right to conduct sales and offer discounts where applicable.
Euro Tripping costs all tours in Australian Dollar (AUD) and as a result reserves the right to reduce or raise prices of other currencies if fluctuations in foreign currency exchange dictate a drop or rise in foreign currency prices.
Euro Tripping reserves the right to increase the tour price or local payments / funds to take into account the following items: entrance charges, government action, currency and transportation costs. If the surcharge results in an increase of more than 10% of the tour price the client may cancel the booking within 7 days of notification of the surcharge and obtain a full refund.
Any possible tour discount needs to be requested at the time of your booking and payment of deposit, any discount or other offer cannot be applied once a booking and deposit has been made. Return traveller and referral discounts are only available on direct bookings.
13. Travel Insurance
Travel insurance is mandatory for all clients whilst on a tour organised by Euro Tripping. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. A suitable insurance policy should provide adequate cover for medical expenses arising through illness or accident prior to or during the holiday and loss of holiday monies through cancellation or curtailment of the holiday or other insurable reasons. Clients should ensure that there are no exclusion clauses limiting protection for the type of activities in their tour. The travel insurance cover automatically provided with credit card purchases does not provide adequate cover as standard.
14. Passports, Visas and Vaccinations
It is the responsibility of the client to be in possession of a valid passport, visa permits, vaccination and preventative medicines as may be required for the duration of the tour. Information about these matters or related items is given in good faith but without responsibility on the part of Euro Tripping. Visa support documents can be provided if the request is received in writing – please email us after your booking has been confirmed, allowing 5 working days for the documents to be produced. Visa support documents do not supplement or replace tour documents which can be found on the website.
Please allow sufficient time to complete the visa process (at least 4 weeks). Should your visa application be unsuccessful, you will be able to change or cancel your tour, but standard terms and conditions (and therefore fees) will apply. Please see sections 3a. Changes by you and 4. Cancellation by you.
The Foreign & Commonwealth Office (FCO) provides travel advice for each destination we visit – each country has a summary and general information as well as advice on safety & security, local laws & customs, entry requirements and health.
15. Age, Fitness and Participation
All clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen tour as described in the itinerary.
Clients are also expected to accept that the components described constitute “Adventure Travel” and that travel to and facilities in developing countries will not be to similar standards which they may be accustomed to at home. Persons over 65 years of age may be asked to provide medical evidence of fitness to travel on certain itineraries. Minors (those under 18 years of age) are accepted on some group tours operated by Euro Tripping at our discretion provided they are accompanied by a parent or guardian who accepts full responsibility for them. Unaccompanied minors will not be accepted. Euro Tripping has recommended ages for participation in group tours which act as a guide only.
Clients agree to accept the authority and decision of Euro Trippings employees, tour leaders, and agents whilst on tour with Euro Tripping. If in the opinion of such person that the health or conduct of a client before or after departure appears likely to endanger the safe, comfortable or happy progress of a tour, the client may be excluded from all or part of the tour, without any refunds. In the case of ill health Euro Tripping may make such arrangements as it sees fit and recover the costs from the client.
If a client is excluded from the tour as above or chooses to leave the tour of their own free will or leaves the tour due to ill health or any other reason there will be no refund of the tour price, extra services, surcharges, local payments/funds or any local surcharges. All services forming part of the whole package booked will be forfeited though may be recovered through travel insurance in some circumstances.
16. Local Laws
All participants in tours operated by Euro Tripping are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve Euro Tripping of any obligation that they may otherwise have under these booking conditions.
17. Illness or Disability
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the tour. Failure to make such disclosure will constitute breach of these booking conditions and result in such persons being excluded from the tour in which case all monies paid will be forfeit.
If you or any member of your party have any disabilities it is extremely important that you contact our offices by email via this link before completing any reservation to ensure compatibility for the holiday that you choose.
If the client has a complaint about any of the tour arrangements the client must bring it to the attention of the tour leader or other representative of Euro Tripping at the time so that they may use their best endeavours to rectify the situation. It is only if Euro Tripping is made aware of any problems that there will be the opportunity to put things right. Failure to complain on the spot will result in the client’s ability to claim compensation from Euro Tripping be extinguished or at least reduced. Should the problem remain unsolved a complaint must be made in writing to Euro Tripping within 7 days of the completion of the tour or all claims for compensation will be forfeited.
19:1. Our Responsibilities
The components operated or supplied by Euro Tripping have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of personal risk and exposure to potential hazards over and above those associated with normal “package travel”. All bookings are accepted with the understanding all risks and hazards are appreciated by the client and they undertake all tours, excursions and activities on own volition.
19:1:1. Where the client does not suffer personal injury, Euro Tripping accepts liability should any part of the component arrangements booked with Euro Tripping not be supplied as described and not be of a reasonable standard. In such a case, Euro Tripping will pay reasonable compensation if the component arrangements had been adversely affected but will pay no compensation if there has been no fault on the part of Euro Tripping or its suppliers and the reason for the failure in the component arrangements was due to force majeure, the client’s fault, the actions of someone unconnected with the component arrangements or could not have been foreseen or avoided by Euro Tripping or its suppliers even if all due care had been exercised.
19:1:2. Where the client suffers death or personal injury as a result of an activity forming part of the component arrangements booked with Euro Tripping, Euro Tripping accepts responsibility unless there has been no fault on Euro Tripping’s part or its suppliers and the cause was due to force majeure, the client’s fault, the actions of someone unconnected with the component arrangements or one which neither Euro Tripping nor its suppliers could have anticipated or avoided even if all due care had been exercised.
19:2. Customer and Passenger Responsibilities
Upon successful completion of a booking, Euro Tripping clients are subject to the responsibilities outlined here.
19:2:1. The client agrees to complete the Important Passenger Information form by no later than 15 days from the departure date. The Important Passenger Information form is automatically emailed to the client after a successful booking and accessed via webpage. Failing to complete the Important Passenger Information form by the close-off date will result in a default booking cancellation and consequently the client will incur the standard cancellation penalties as per clause 4 of this agreement.
a. The client agrees to arrange his/her own travel insurance by no later than 15 days from the departure date.
b. The client agrees to obtain an insurance policy that will provide adequate cover, prior to or during the holiday, for the following:
i.Loss of holiday monies through cancellation
ii. Loss of monies through curtailment of the holiday or other insurable reason.
iii. Cover for repatriation
iv. Failing to obtain a suitable insurance policy within the requested time-frame will result in a default booking cancellation and consequently the client will incur the standard cancellation penalties as per clause 4 of this agreement.
c. The client agrees to book his/her own flights. Euro Tripping is not responsible for administrating flight bookings.
d. The client agrees to obtain a valid passport and a valid visa permit in time for, and for the duration of, the tour. Please refer to point 11 for further information regarding Passports, Visas and Vaccinations.
19:2:2. The client agrees to pay all monies within the timeframes stipulated in invoices or any other form of payment notice communicated by Euro Tripping.
20:1:2. About cookies
A cookie is a small file placed on your computer to collect standard internet log information and visitor behaviour information in an anonymous form. Cookies can be used by web servers to identity and track users (in anonymous aggregates, not individually identifiable users) as they navigate different pages on a website and identify users returning to a website. Cookies may be either “persistent” cookies or “session” cookies. A persistent cookie consists of a text file sent by a web server to a web browser, which will be stored by the browser and will remain valid until its set expiry date (unless deleted by the user before the expiry date). In order to process bookings Euro Tripping is required to collect certain personal details from you. These details will usually include the names and addresses of party members, credit / debit or other payment details and special requirements such as those relating to any disability or medical condition that may affect the holiday arrangements. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass some information on to the relevant suppliers of your travel arrangements (hotels, transport companies etc.). Such suppliers may be outside continental Europe if your holiday is to take place or involve suppliers outside these countries. The information may also be provided to security or credit checking companies, public authorities such as customs / immigration if required by them, or as required by law. Except where expressly permitted by the Data Protection Act 1998, Euro Tripping will only deal with the personal details you give Euro Tripping as set out above unless you agree otherwise. We may make contact with you or members of your holiday party by post, e-mail, or telephone for the purposes set out. We will also use your information to inform you of offers in the future or to send you brochures. If you do not wish to receive such approaches in the future then please let us know as soon as possible. If we do contact you by e-mail about our new brochures or special offers, you will also be able to unsubscribe yourself from our database at this time. Euro Tripping will assume that you do not object to being communicated with unless you have previously opted out or contacted us.
21. Brochure / Website / Advertising Material Accuracy
The information contained in our brochure, on our website and in other advertising material is believed correct to the best of our knowledge at the time of publication. Errors may occasionally occur and information may subsequently change, therefore please ensure you check all details of your chosen component (including the price) with us or your travel agent at the time of booking. Euro Tripping cannot be held responsible for any error, omission or unintentional misrepresentation that may appear in the brochure, on our website or in other advertising material.
22. Lost property
If you have lost an item during your holiday, you must report it to Euro Tripping within 7 days of your return home. We will try to help find the item and if found, we will find a way to post it to you. You will be charged the cost of postage and a handling fee of $50 per lost item. Euro Tripping accepts no liability for helping with your lost property. Euro Tripping takes no responsibility for any loss or damage to your luggage while on our vehicles or public transport.
23. Agency for flights/local guides/transfers & holiday activities
We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers. We can provide you with copies of the relevant service provider terms and conditions on request. Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.
To the extent permitted by law, neither Euro Tripping Travel nor any of its related bodies corporate, owners, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
